Affidavit of Entitlement

What is an Affidavit of Entitlement?

Today we are discussing small estates under $25,000.00, meaning that a person that passed away has an estate valued at no more than $25,000.00, and what to do in this case.

When this is the case, it is likely that you do not need an attorney to claim the estate. While it is unfortunate that someone has passed away, the good news is that if their estate is valued to be low, then you will not need to go through Probate court and you will not need an attorney. What you can do if the value is under $25,000.00 and there’s no real property, is submit something called an Affidavit of Entitlement.

The next of kin would fill out the Affidavit of Entitlement and sign it. At that point they would be able to access the decedent’s bank accounts or whatever the property is that they’re trying to access, and get control of it.
